A Toronto judge tossed out criminal charges against a woman accused of causing a 0.2-inch tear in her neighbor's garden hose.
Kathryn David, 65, appeared in Provincial Justice William Wolski's courtroom earlier this month on a mischief charge stemming from an October 2011 incident, the Toronto Star reported Wednesday.
David was arrested and charged after neighbor Kevin Cooper's security camera recorded her removing his hose from their shared driveway. The video depicts David pulling on the hose, leading it to catch on a lawn chair and causing a 0.2-inch tear in the hose.
"Fortunately for the Toronto Police Service, the Supreme Court of Canada has said that stupidity in relation to the law and negligence is not a case for malicious prosecution," Wolski said in dismissing the charge. "Why these charges were laid is still a mystery to me."
