Former Jon & Kate Plus 8 star Jon Gosselin is claiming he never wanted primary custody of his eight children with ex-wife Kate Gosselin and is blaming his former attorney Anthony List for making a court filing requesting it.

"I never wanted primary custody, he filed for that," Gosselin told TMZ in a Thursday interview.  "I only wanted a more flexible custody schedule so I could be with my kids."

According to TMZ, List filed the legal papers requesting primary physical custody in Berks County, PA family court on April 7 without Gosselin's permission -- a claim List denies.

"Jon signed off on everything," he told TMZ.

List had previously told TMZ that Jon still planned to press onward with his court filing for primary physical custody despite Kate's ouster from Dancing with the Stars earlier this week.

However Gosselin subsequently stated in a Thursday morning Twitter post that List was "terminated" on April 15, meaning "he has no legal right" to speak to the press or anyone on his behalf -- an allegation he reiterated to TMZ on Thursday.

"It's illegal. He can't speak on my behalf if he was terminated," he told TMZ. "I filed a termination letter on April 15."

In addition to his motion for primary physical custody, Jon also requested a judge review his current child support arrangement with Kate that currently has him paying $21,700 a month.

However Jon told TMZ he still wants to pay child support, he "just can't afford the $22,000 a month right now."

"That is why I'm trying to find a job," he added. "I would like a job in some aspect of TV, probably as a host."

While the former Jon & Kate Plus 8 stars are currently due in Pennsylvania court on May 25 for a hearing on Jon's motion, he stated in his Twitter post that he'd like to work with Kate and her attorneys "privately and amicably."
