90 Day Fiance star Jay Smith is currently in the custody of U.S. Immigration and Customs Enforcement and facing deportation after he was arrested Wednesday for violating a protective order his estranged wife had obtained against him.

Ashley and Jay originally appeared on the sixth season of 90 Day Fiance on TLC last year, and are currently appearing on Season 4 of 90 Day Fiance: Happily Ever After, which has shown the couple's relationship on the edge of divorce and will air its season finale on TLC on July 14.

While they didn't refer to Ashley by name, Ashley's local police confirmed Jay's arrest in a statement on their website.

"On July 2, 2019, Upper Allen Police investigated a report of a PFA violation. The protected party lives in Upper Allen Township and reported a social media post made by Smith, which was in violation of the order," they stated in the posting.

"As a result of the investigation, an arrest warrant was obtained for Smith."

According to In Touch Weekly, Jay then turned himself into police on Wednesday after learning there was a warrant for his arrest.

"On July 3, 2019, Smith was taken into custody without incident. Smith was transported to the Cumberland County Prison for processing and arraignment. A hearing will be held at a later date," the Upper Allen Township police said in their statement.

However, U.S. Immigration and Customs Enforcement was reportedly contacted after Jay was arrested and Jay was subsequently transferred to York County Prison in Pennsylvania.

"He's in our custody. He's just getting put into the facility," a U.S. Immigration and Customs Enforcement spokesperson told Radar Online.

"It looks like he's going to be going through the motions. He will see an immigration judge to see if he'll be deported."

Ashley had reportedly obtained the Protection From Abuse order on July 1 -- only one day before Jay allegedly violated it. However, it was not immediately clear what led to her decision to file the order.

According to In Touch Weekly, Jay had posted an Instagram Story video with cryptic lyrics about a person "turning" themselves in shortly before he was arrested.

On Wednesday, Ashley posted and then quickly deleted an Instagram Story commenting on Jay's arrest. 

"Mark my words this is the hardest day of my life. I can't believe this is how it ended. The amount of sadness I'm feeling is unfathomable. There is no celebrating over here, just pure heartbreak!" she wrote in a copy of the posting obtained by 90 Day Fiance Instagrammer John Yates.

However, Ashley's spokesperson Johnny Donovan then made subsequent comments suggested Ashley wasn't completely heartbroken about Jay's arrest and detainment.

"Ashley feels as though Jay made his own bed," he told Us Weekly. "Ashley has been suffering for a long time -- it's payback. Jay thought she was joking, but no. He made his bed, and now he has to lie in it."

"Ashley is taking the weekend to focus on herself and on her kids. Ashley and Jay are due back in court this Tuesday and Wednesday."

Ashley, 32, and Jay, 21, got married in May 2018 after Jay arrived in America on a K-1 visa, which gave the couple 90 days to get married or Jay would have to return to his home country of Jamaica.

Ashley initially filed for divorce from Jay on January 11.  However, she later withdrew the paperwork just 11 days later on January 22.

She then filed for divorce from Jay for the second time in April, citing "adultery" on Jay's part as the reason for their split following months of cheating allegations and rumors.

Last month, Ashley had stated she was expecting Jay deported back to Jamaica in August and claimed he was so desperate to remain in America that he had offered to pay her to withdraw her divorce filing and re-file his adjustment of status paperwork.

"He will be deported on August 7 unless he runs, which is what I'm assuming he's probably [planning]," Ashley said during a pair of Instagram Live sessions she conducted with Yates, explaining she and Jay had a court hearing scheduled for August 7.

"The thing that's really frustrating is he's here illegally now... I did file for his adjustment of status, and then two weeks later he screwed up again, so I withdrew it," Ashley told Yates.

According to Ashley, her withdrawal of Jay's adjustment of status paperwork meant he was no longer in the United States legally and U.S. Immigration and Customs Enforcement had already visited her home attempting to arrest Jay -- whom Ashley claims has also been working illegally -- for deportation.

"[Immigration and Customs Enforcement] has already been here to arrest him. They know where he works... I mean obviously if they come to my house at this point, I'm gonna tell them where he's at. So I'm not sure why he's still sticking around because we got a letter three weeks ago saying he has an active warrant for his arrest," Ashley said in June.

"I didn't know this, but your local police department can not arrest somebody for being an illegal immigrant. ICE has to arrest him. They have to come from Philadelphia and arrest him."

"So unless Jay would like assault me or something, then [in that case the local police] would contact immigration and say, 'Hey, we just charged Jay with assault, he's wanted for deportation,' and then ICE would take over," she added, hypothetically detailing the scenario that appears to have resulted in Jay's July 3 detainment.

Ashley had also insisted the drama in her life would be "over" after the August court hearing.

"It's not 'if.' He 'is' going to get deported, and he knows he is. And he even called me. He went to the attorney and he said like, 'I'm f-cked.' Like he even offered money -- like, 'Can I pay you to withdraw the divorce?'" Ashley claimed.

Ashley had said Jay offered her "his tattoo money that he makes illegally, because he's not allowed to work."

"He does tattoo and gets paid fully for it, but they're claiming that he's 'an apprentice,'" Ashley told John.

Ashley told Yates that Jay had moved out of their shared Pennsylvania home while Ashley was visiting Texas in May.

"We were not getting along -- he was sleeping with multiple women -- so I actually, we got the money for [filming] the [90 Day Fiance: Happily Ever After?] Tell-All. When we film the Tell-All, we get paid that day," Ashley began.

"So I actually offered to pay two months of his rent to get him out of my house because he wouldn't leave my house. Yeah, that's how he's there in his own apartment... He has family in Miami. His parents are here illegally, they live in Colorado. Like he has places to go, so I'm not sure why he's still here."

Ashley had told Yates that Jay had been sending her mixed messages and signals ever since he moved out. Some of the time, Jay was allegedly begging Ashley for another chance.

"I have text messages from him from three days ago telling me that he has a sex addiction problem and he'll go to counseling, [and that] he wants to go to couples counseling and he wants to work things out," she said.

"You know why? Not because he loves me and he wants to work things out. [It's] because we get paid from TLC [for the season] in one lump sum when the last episode airs. So that's a lot of money at one shot. He wants the money."

Ashley added, "And he's been begging me since the day I filed for divorce to withdraw it and re-apply for his green card."

Ashley had claimed Jay was doing whatever it takes to stay in America.

"The only person that can save him is me, and that's why Jay keeps flip-flopping -- which is mind-f-cking me!," Ashley insisted.

"Because, one day it's like, 'Don't talk to me, I'm out partying with bitches and strippers and hoes and drinking Hennessy and smoking pot.' And then the next day, it's 'I love you, I'm sorry, I have a sex addiction, let's go to couples counseling and work through this.' Because I'm the only person that can save him from being deported."

While it was already filmed before Jay's arrest, 90 Day Fiance: Happily Ever After's Season 4 Tell-All is scheduled to air on TLC as a two-part special on July 21 and July 28.
