Security camera video from a Sunset Strip store allegedly showed Hilton ripping up a poster and stealing a DVD of an X-rated video of herself, "1 Night in Paris,""Celebrity Justice" said Wednesday.
The Los Angeles district attorney's office, which viewed the surveillance video, decided to reject a recommendation from the county sheriff's department that she be charged with petty vandalism and misdemeanor theft.
"Who does she think she is?" asked Jerry Castro, the clerk on duty at "Swing News" in December when the "Simple Life" star entered. "What is the D.A. thinking that they're letting her get away with this?"
Castro said Hilton got angry when she spotted the 120-minute amateur porn video of her with former boyfriend, Rick Salomon.
