Larry Birkhead files paternity lawsuit against Anna Nicole Smith

The man who says he is the father of Anna Nicole Smith's baby, Larry Birkhead, is preparing to mount a legal attack on the Trim Spa spokeswoman in the Bahamas.

Birkhead's attorney, Depra Opri, said in a statement outside of the Los Angeles County Courthouse that Birkhead has filed a conspiracy and fraud claim against Anna Nicole, her lawyer-lover, Howard K. Stern, and the registrar who certified the baby girl's birth certificate, TMZ.com reported Friday.

Birkhead alleges that Stern and Smith fraudulently represented Stern was the father of DannieLynn Hope by signing the birth certificate.

The lawsuit requests that the registrar general in the Bahamas change the baby's last name on legal documents from Stern to Birkhead. "It will be up to this government entity to pursue any criminal investigations against Anna Nicole Smith and/or Howard K. Stern," Opri said.

Opri also said there is a risk Smith will flee the Bahamas to avoid a charge, reported People Magazine.
