The divorce papers also set the parenting responsibilities for the couple's three children, Avery, 7, Olivia, 4, and Elizabeth, 2, People magazine reported.

Legal papers issued by Tennessee's Chancery Court said, "The mother and father will behave with each other and each child so as to provide a loving, stable, consistent, and nurturing relationship with the child even though they are divorced. They will not speak badly of each other or the members of the family of the other parent. They will encourage each child to continue to love the other parent and be comfortable in both families."

Evans' home will be the kids' primary residence and, if the judge approves, she will decide educational, non-emergency health care, religious upbringing and extracurricular activities for the children, the report said.

Evans filed for divorce on Oct. 12 claiming that Schelske was adulterous and used pornography. He denied Evans's claims and accused her of having an affair.
