90 Day Fiance: Before the 90 Days star Ben Rathbun has been arrested in connection with a previous drunk-driving offense.

Ben has found himself in some trouble and was arrested on Tuesday, March 15 after he failed to show up for a recent probation hearing.

According to court documents, the 52-year-old from Fraser, MI, was originally arrested in 2020 for operating a car while under the influence of alcohol and driving with a suspended license, Us Weekly reported.

Ben was sentenced to 18 months of probation in January 2021, and he missed a scheduled hearing appearance in late February 2022.

Due to Ben's absence, a judge issued a bench warrant and then the reality TV star was taken into custody again in Michigan on Tuesday.

Ben -- who stars on Season 5 of 90 Day Fiance: Before the 90 Days with Mahogany Roca, a 22-year-old from San Bartolo, Peru -- now remains in custody and has bail set at $10,000.

As shown on the latest season of 90 Day Fiance: Before the 90 Days, Ben grew up in a mainstream Baptist denomination that was "very much like a cult."

In order to align with the rules of his religion, Ben decided to become a pastor and marry his church's children ministry partner. The couple went on to welcome four children together but encountered some problems.

"In our belief system, it was either stay together or go to an eternal lake of fire forever. So about seven years ago, we left that religious cult in an attempt to save the marriage, and we did seek counseling," Ben explained in a previous episode of the series.

"But by the time we did that, it was too late. It was 24 years of neglect, and so I filed for divorce."

After Ben left his wife and the church, he confessed that he felt completely lost and had to do some soul searching.

He was also very lonely and so he explored a few dating websites, one of which connected him with Mahogany, the "most remarkable woman" he had ever met.

The pair communicated for four months and deeply bonded over their faith, morals and values, but they never videochatted or spoke on the phone.

Ben ultimately decided to fly to Peru and meet his dream girl in person, despite his family's concerns Mahogany's pictures were clearly edited and she may lack emotional maturity.

Ben's family and friends weren't even sure Mahogany, who claimed she was 24 years old, was real. After all, Ben had been catfished once before.

Mahogany attempted to cancel Ben's trip, saying her father wouldn't approve of Ben visiting her, but Ben didn't want to wait any longer to prove what he and Mahogany had was real.

Once Ben arrived in Peru, Mahogany was nowhere to be found and she didn't answer any of his text messages. After 24 hours, Ben asked Mahogany to meet him at a restaurant in her hometown of San Bartolo, and she actually ended up making an appearance.

Ben called Mahogany "beautiful" -- although she didn't exactly look like her online photos -- and said their official meeting was "unbelievably magical" and totally "worth the wait."

But Ben quickly realized they were on two different pages. Mahogany hadn't told her friends that she had a boyfriend, and she wouldn't say, "I love you," back to Ben once he said it.

Ben also noticed some red flags when Mahogany gave her a tour of her alleged condo, which was incredibly well-kept and expensive. He was convinced she didn't actually live there, and then Ben found out Mahogany had also lied about her age and she was only 22 years old.

"There are things that don't add up, and so I'm trying to create some emotional distance right now. But that's really, really hard because my heart is in this," Ben shared in a confessional.

The couple proceeded to get to know one another better, but Mahogany was turned off when Ben apparently took no accountability or fault for the demise of his previous marriage and failed engagement. Mahogany said he blamed the women he had been with.


"I can't imagine a pastor not taking responsibility for his mistakes," Mahogany complained to the cameras. "It's very immature, very strange. I'm a little worried that Benjamin isn't the same person I thought he was."

Ben claimed he had explained himself to Mahogany via text but she never responded, and so the latest episode of 90 Day Fiance: Before the 90 Days featured Ben standing Mahogany up at breakfast and asking to speak to her parents alone.

In a recent interview with Entertainment Tonight, Ben insisted that his age difference from Mahogany doesn't matter.

"It's just something that caught me off guard. I had to think about it for a minute," he noted.

"But this has become so much more than age, so much more than, you know, our differences. The things we've been really focusing on are our commonalities... She is so mature and wise and intelligent, that I haven't really felt that difference."

Ben added, "It's not about the age to me. I met someone whose heart and whose soul is just so beautiful and someone that I can just connect with on such a different level that I just didn't want to let that go."

Ben also insisted he's not "a predator" after receiving backlash for having a daughter who's the same age as Mahogany.

"Trust me when I say the dad cares more about the situation than anyone from the outside," he said.

"He sees that I am very, very healthy... [I] take care of my body and it's a huge priority and I want to live for a very long time and I want to live in the best health that I can."

And on the topic of Mahogany's alleged condo, Ben shared that she had actually been living there for a couple of months at the time of his tour.

"I'm sure most of her stuff was in her parents' house. For Peru, that is their off season, I went during their winter. So, there's not a lot of tourists. Those really nice condominiums there are very inexpensive," Ben explained.


"She's got a great job, she's got a great future. She is going to become an international lawyer, and she has money and her parents have money."
