"The Simple Life" star Nicole Richie may have to spend 5 days in jail if she is convicted of her latest impaired driving arrest because of a 2002 conviction.

The New York Post reported Thursday Richie pleaded no contest to drunken driving four years ago and was sentenced to three years' probation. If convicted, a second DUI conviction comes with a mandatory five-days in jail in California.

Richie was pulled over Monday after being spotted driving against highway traffic. She reportedly admitted to having taken Vicodin and smoking marijuana prior to driving.
