90 Day Fiance star Jay Smith has allegedly received a notice to appear in court next month for a hearing that could result in his deportation.

Last month, Jay's wife and 90 Day Fiance co-star Ashley Martson conducted an Instagram Live session with blogger Johnny Yates and claimed an Immigration and Customs Enforcement official had come to her house and served Jay a notice to appear in court.

The immigration official's appearance occurred before this month's recent drama in which Ashley threatened to divorce Jay and send him back to Jamaica on social media for being "a cheating ass."

However, late Sunday night, Yates posted screenshots of arrest warrant and removal proceedings documents on Instagram that are dated February 4 and order Jay to appear in court on May 8, 2019 in Philadelphia, PA. 

The U.S. Department of Homeland Security documents notify Jay that he may be deported under the Immigration and Nationality Act because he has overstayed his visa and remained in the United States longer than he was permitted.

According to the documents, Jay arrived in the United States on March 6, 2018 on a K-1 visa that only allowed him to stay in America until June 3, 2018 and he has been living in the U.S. without any legal authorization since then.

As a result, Jay is "removable" and the Department of Homeland Security has initiated removal proceedings against him.

Given Ashley and Jay did end up getting married after he arrived in America, the documents seem to indicate Ashley never filed the additional "adjustment of status" paperwork that would have allowed Jay to remain in the United States legally following their wedding.

90 Day Fiance's sixth season showed Ashley and Jay's relationship hit the skids when Ashley caught Jay messaging other women on dating apps only a couple of days after their wedding, and the season ended with Ashley unsure whether she wanted to continue the marriage.

Ashley seemingly confirmed she and Jay had split last week. Not only did she change her bio section of Instagram to "Single AF," but Ashley also did not deny the breakup when a fan asked about her current relationship status.

A couple of days earlier, Ashley accused Jay of being a "disgusting cheating ass" and using her car and money to go to a strip club.

Ashley has recently expressed on more than one occasion how her marriage is over and she hopes Jay will be deported back to his native country of Jamaica. She even asked "thirsty girls" on social media to take Jay off her hands.

Ashley previously filed for divorce in January 2019, but she withdrew the paperwork just two weeks later and subsequently admitted her December 2018 breakup -- which sparked when Ashley caught Jay flirting with other women on Tinder -- with the Jamaican tattoo artist was faked.

Fans therefore questioned whether the divorce filing was a scam since the couple had been accused of leaking their own personal stories for publicity and pretending there were problems in their relationship.

"Ashley is indeed filing for divorce after catching Jay cheating yet again," a source recently told In Touch Weekly.

"She has reached her breaking point and this is the final straw. She feels like she was an opportunity for him and she is hurt and disgusted."

Ashley and Jay, who initially starred on Season 6 of 90 Day Fiance, will be appearing on Season 4 of 90 Day Fiance: Happily Ever After? when it premieres Sunday, April 28 at 8PM ET/PT on TLC.
