A North Dakota man returned to prison after he was found to have violated his probation for a third time by possessing women's underwear.

David Haberstroh, 23, of Bismarck, who pleaded guilty to Class B felony burglary in 2006 for breaking into a neighbor's apartment and stealing her underwear, admitted Tuesday to violating the terms of his probation by possessing 12 pairs of women's underwear, eight pairs of children's underwear and sexual content on his cell phone, the Bismarck Tribune reported.
Haberstroh, who also admitted to violating his probation by lying to authorities about his relationship with a woman who has a child, was initially sentenced to five years of supervised probation in 2006, but was re-sentenced to five years in prison, with all but 30 months suspended, when he was found to be in possession of women's underwear.
Haberstroh was imprisoned again less than a month after his April 5, 2010, release when his probation officer reported he was in possession of 119 pairs of women's underwear and two pairs of children's underwear in addition to other forbidden items. He was sentenced to five years in prison with all but 36 months suspended and credit for time served, resulting in a six-month prison stay.
South Central District Judge Sonna Anderson sentenced Haberstroh Tuesday to five years with credit for time served, amounting to two years in prison.
