Maker of 'Milkdudz' in battle with Hershey

UPI News Service, 10/29/2005

A California woman who runs a garage business producing clothes for nursing mothers is fighting a legal challenge to her company's name, Milkdudz.

Hershey Co., the chocolate empire, has warned Kiersten Wall that the name tramples its trademarked Milk Duds, the chocolate-covered caramels. The letter came with a 5-pound candy bar, but when Wall continued to use the name Hershey took the gloves off, the Los Angeles Times reported.

Wall received a notice last week from the U.S. Office of Patent and Trademark Protection that Hershey has filed a protest against her company name.

Wall said she does not believe she is causing a problem. But she also said she does not have the resources for a long legal battle against a company with billion-dollar revenues, although she plans to fight as long as she can.

"Our products would never be in the same place at the same time," she said.
