Insect swarm attack leads to lawsuit

An insect swarm attack on a small boy at a Chuck E. Cheese's restaurant in New York has led to a lawsuit against the popular children's restaurant.

Kimberly Halpern has filed suit against the Staten Island restaurant and the mall it resides in, alleging that the incident caused her 4-year-old son, Austin, to endure psychological damage, said the New York Post.

The suit claims a swarm of flying insects came out of a vent of the video game Austin was playing in June 2005, and that the attack has left him petrified by the thought of Chuck E. Cheese's.

The attack also caused Austin to faint and be immediately rushed to an area hospital for medical attention, the lawsuit claims.

"We offered to pay for his emergency room visit," restaurant spokeswoman Brenda Holloway, said. "They turned us down and said they were going to sue."

The Post reported that Holloway claimed no sign of the insect swarm was found by an exterminator the next day and no other customers suffered a similar incident that day.
