The LA District Attorney referred the case -- in which Harrelson allegedly grabbed the photographer by the neck and broke his camera -- to the City Attorney's office for possible prosecution, E! Online reported.
Harrelson was leaving an LA nightclub on July 6 when he was filmed by TMZ cameraman Josh Levine. When the actor asked Levine to stop, the cameraman continued -- Harrelson asked again and put his hand over the camera.
"All I'm doing is my job," said Levine. Harrelson spoke to him again and then broke his camera.
A second video allegedly shows Harrelson putting his hands on Levine's neck, TMZ reported. Levine filed a complaint with the Los Angeles Police Department.
The cameraman said that he went to the hospital where he was treated for minor abrasions on his neck and promptly sent home, e!online said.
Deputy District Attorney Alisanne Scolnik Augusta said the force used "is not to the level that would cause great bodily injury," and the photographer's video footage of the incident did not "reveal a clear intentional breaking of the camera by the suspect."
