The Sumter County Sheriff's Department said Jay Follin was separated but not divorced from his first wife when he married Melissa McLeod on July 20, 2004.
Maj. Gary Metts said Follin knew he was legally married when he married Melissa McLeod, who was also married at the time. Her husband, Kelly McLeod, said his wife, from whom he was separated, recently told him she married Follin, the Columbia State reported.
On Monday, Kelly McLeod filed a complaint against Follin with the department, saying he had obtained a copy of the marriage license from Georgia.
Neither Follin nor Melissa McLeod has been charged, but they could face charges once the State Law Enforcement Division concludes its investigation or Kelly McLeod signs a warrant.
