Farrell won a temporary restraining order in July barring Nicole Narain from selling the steamy tape Farrell claims they had agreed to always keep private.
On Wednesday, a Los Angeles superior judge granted Farrell's request to take the case to trial in his effort to permanently quash the 15-minute video, "Access Hollywood" reported Thursday.
Farrell, 29, went to court as soon as he learned Narain, 31, was trying to sell the tape through a third party. His suit also charged Narain planned to release the tape through an Internet pornography site.
His suit says the couple agreed they jointly owned the tape and had promised to always keep it between them. If it were made public, Farrell's career would suffer irreparable harm, his suit says.
