Chicago judge refuses to toss R. Kelly child pornography case

A Chicago Criminal Court Judge Friday denied a defense motion to dismiss child pornography charges against singer R. Kelly.

Judge Vincent Gaughan ruled prosecutors had sufficiently narrowed the timeframe in which they allege Kelly filmed himself having sex with a teenager and set a status hearing for Dec. 9, the Chicago City News Bureau reported.
Kelly is free on $1 million bond and was not in court Friday. He was in Atlanta to perform at a benefit concert for Hurricane Katrina victims.
Prosecutors say Kelly made the videotape between Jan. 1, 1998, and Nov. 1, 2000, which would have put his partner under the age of 18.
Kelly was arrested and charged in April 2002.
