Former Survivor: Pearl Islands castaway Jon "Jonny Fairplay" Dalton has filed a lawsuit against Danny Bonaduce, alleging the former Breaking Bonaduce star caused him both emotional and physical distress following an altercation the two had during filming for the Fox Reality Channel Really Awards ceremony last week.
The lawsuit was filed Tuesday in Los Angeles Superior Court and also names Fox Reality Channel and Natural 9 Entertainment (the co-producers of the second-annual awards show) and Boulevard3 (the club where the show took place) as defendants. Dalton is seeking unspecified damages to cover medical expenses, emotional distress and lost earnings, as well as punitive damages, according to the lawsuit, a copy of which was obtained by TMZ.com.
Bonaduce has claimed he was preparing to leave the awards ceremony after serving as a presenter when Dalton started to question the studio audience as to why he was being booed by them. Bonaduce alleges he told Dalton they're booing him because "they hate him," at which point he claimed Dalton ran at him, leapt in the air, and wrapped "his legs around my waist and both arms around my neck" and was "fully throttled."
"I just grabbed the butt of his jeans and push[ed him] straight-up in the air," said Bonaduce during last Wednesday morning's broadcast of the syndicated The Adam Carolla Show radio program, which he regularly appears on as a co-host. "Well, he goes flying over my head and apparently landed behind me on his seat."
However in a police report filed by Dalton last Wednesday, he claimed Bonaduce came on stage uninvited and made a "derogatory statement."
"I ran and jumped and hugged him with my arms and my legs, like I've done pretty much on every show I've ever been on. It's a nice thing," Dalton told TMZ.com in an interview last week. "[Bonaduce's] like 'F**k you!' Threw me over his head as hard as he could. I didn't have time to put up my hands or anything. I just went mouth-first into the stage... or onto the stage."
Dalton suffered a broken tooth, had another tooth missing from his gum line and two other teeth loosened due to being dumped to the ground by Bonaduce.
While the Los Angeles Country District Attorney's office ruled last Thursday that Bonaduce would not be charged with battery because he "simply reacted to" Dalton's actions, the former Survivor castaway claims in his lawsuit that the former child actor's actions were "an unjustified and surprise assault."
In addition, the lawsuit claims Dalton "playfully" jumped into Bonaduce's arms, an "act" that is "known" to be part of his "routine," and was "something that the two had previously done before." He also alleges Bonaduce took "pride" in the attack and "encouraged the audience to applaud."
"Meanwhile, Mr. Dalton bled profusely from the face and mouth," reads the lawsuit. "Instead of immediately calling an ambulance to care for the injured presenter or taking other action, the defendants -- including the television channel, the producers and the owner of the venue hosting the event -- did nothing."
In addition to suing Bonaduce for battery, intentional infliction of emotional distress, and negligence, Dalton also took aim at Fox Reality Channel.
In the lawsuit, Dalton claims the defendants allowed the battery to occur; encouraged Bonaduce to go onto the stage uninvited; did not provide adequate, or any, security; ignored Dalton once he was bleeding; as well as failed to administer immediate medical care or contact medical personnel.

Former Breaking Bonaduce star Danny Bonaduce will not be charged with battery for his Tuesday night Fox Reality Channel Really Awards altercation with former Survivor: Pearl Islands castaway Jon "Jonny Fairplay" Dalton.
"It did not appear that the suspect intentionally tried to cause injuries, but simply reacted to the victim's actions," the Los Angeles Country District Attorney's office wrote in a charge evaluation worksheet that was filed Thursday and obtained by TMZ.com.
During Wednesday morning's broadcast of the syndicated The Adam Carolla Show radio program -- which Bonaduce regularly appears on as a co-host -- the former child actor claimed he was preparing to leave the second-annual awards ceremony after serving as a presenter when Dalton started to question the studio audience as to why he was being booed by them.
Bonaduce told Dalton they're booing him because "they hate him," at which point he alleged Dalton ran at him, leapt in the air, and wrapped "his legs around my waist and both arms around my neck" and was "fully throttled."
"I just grabbed the butt of his jeans and push[ed him] straight-up in the air," Bonaduce told Carolla. "Well, he goes flying over my head and apparently landed behind me on his seat."
However in the police report filed by Dalton on Wednesday, he claimed Bonaduce came on stage uninvited and made a "derogatory statement."

Dalton suffered a broken tooth, had another tooth missing from his gum line and two other teeth loosened due to being dumped to the ground by Bonaduce. But Dalton was reportedly consuming alcohol prior to the incident, which may explain why the occasional professional wrestler was unable to shield his mouth before he hit the ground.
"Jonny was drinking heavily backstage," HBO's Cathouse: The Series star and Moonlite Bunny Ranch brothel member Brooke Taylor told the New York Daily News in a report published Friday.
Bonaduce claimed self-defense for his actions -- a stance the district attorney's office feels is reasonable.
"[The] suspect's actions fall within the realm of self-defense," the filing states. "[There is] insufficient evidence to prove beyond a doubt since [the] victim initiated contact and acted offensively."
In addition to finding out the district attorney's office doesn't plan to prosecute Bonaduce, Dalton -- who recently announced he is expecting a child with girlfriend and former America's Next Top Model fourth-season finalist Michelle Deighton -- may also have some new explaining to do.
"He was trying to make out with me and [fellow Ranch-hand] Bunny Love," Taylor told the Daily News of Dalton's actions backstage at the awards show. "He tried to put his hand up my dress. He even tried to lick my toe. All the while, he was talking to me about his pregnant girlfriend. Classy."

Former Survivor: Pearl Islands castaway Jon "Jonny Fairplay" Dalton filed a police report Wednesday alleging Breaking Bonaduce star Danny Bonaduce physically assaulted him during Tuesday night's filming of the Fox Reality Channel Really Awards 2007.
"He had one tooth broken, another tooth missing from his gum line and two other teeth that were loose," LAPD Officer April Harding told The Associated Press. "The investigation's in its initial phase. Currently we don't have any plans to arrest Bonaduce."
During yesterday morning's broadcast of the syndicated The Adam Carolla radio show -- which Bonaduce regularly appears on as a co-host -- the former child actor claimed he was preparing to leave the second-annual awards ceremony after serving as a presenter when Dalton (who bills himself as the "most hated man in reality television") started to question the studio audience as to why he was being booed by them.
Bonaduce told Dalton they're booing him because "they hate him," at which point he alleged Dalton ran at him, leapt in the air, and wrapped "his legs around my waist and both arms around my neck" and was "fully throttled."
"I just grabbed the butt of his jeans and push[ed him] straight-up in the air," Bonaduce told Carolla. "Well, he goes flying over my head and apparently landed behind me on his seat."

Dalton stuck to that story during a Wednesday interview with TMZ.com.
"I ran and jumped and hugged him with my arms and my legs, like I've done pretty much on every show I've ever been on. It's a nice thing," Dalton told TMZ. "[Bonaduce's] like 'F**k you!' Threw me over his head as hard as he could. I didn't have time to put up my hands or anything. I just went mouth-first into the stage... or onto the stage."
"Jonny was definitely injured," his manager Marc Marcuse -- who rode alongside Fairplay in the ambulance from the ceremony to the hospital -- told E! News. "I was there at the event and there were gasps from the audience and it was very surprising. Nobody thought Danny would do that. It was scary."
Dalton told TMZ that after going to the hospital he was sent to see a dentist, where he was "in surgery for about two-and-a-half hours," suffering from having one tooth "knocked out" and three others "moved."
"There's like floating bones, and one tooth is shattered like eight times, like eight breaks or whatever," he told TMZ. "They did one root canal [Wednesday night], they're doing two more root canals [Wednesday]. It sucks."
While Bonaduce told TMZ Dalton was "just attacking the wrong guy" and "in the very least it will be self defense," the former Survivor castaway disagrees.
"I don't think I can attack anyone. Have you seen me?" Dalton -- who attempted to launch a professional wrestling career after his Survivor appearance -- told TMZ. "So... He was right about everything else. He did say he threw me hard, and I was a lot lighter than he thought. He's a dick. I've already pressed charges. They're just waiting for the video from Fox Reality."
Marcuse told E! News that police had to take Dalton's statement and make a report for his client to be admitted to the emergency room.
"At this point it's in the hands of the LAPD," Marcuse told E! News. "With that being said Johnny certainly wants to see justice done and he will cooperate."
The incident gets even weirder if you believe original America's Next Top Model winner and My Fair Brady co-star Adrianne Curry, who claimed responsibility for the physical altercation between Dalton and Bonaduce in a blog entry posted on her personal website on Wednesday.
"I can't sleep because I made a TERRIBLE thing happen," wrote Curry on her website before revealing she was the one who implored Bonaduce to go after Dalton.
"Danny Bonaduce whispers in my ear 'Do you think I should go up there and tell him what a douche he is?' Naturally I say YES! Then he tells me 'Do you want me to tackle him?' Silly me, I said 'DO IT DANNY!!!' I then proceeded to cheer Danny's name till he got up to walk onstage."
As Curry said she watched Dalton "wrap his arms around Danny's neck" and "his legs around Danny's waist," she construed Dalton's actions as a "hump."
"I started shaking, I HELPED THIS HAPPEN! Danny got PISSED. He grabbed Johnny, lifted him up, and THREW him over his f**king head... that aint all folks... Johnny flew up in the air, and landed on his FACE," she wrote. "Yep, you heard it here ladies and gentlemen.. .Danny Bonaduce went up onstage because of ME, slammed Johnny Fairplay, and knocked out his front teeth! Blood was on the floor, as well as teeth."
While Curry reiterated she feels "terrible," she added Dalton should also bare some of the blame.
"I know it wasn't my fault that Johnny was STUPID enough to try to piss off Danny, but I know Danny might not have gone up there if I hadn't cheered him on," she wrote. "Is it bad that secretly, I thought it was a little awesome? I mean, who the F**K would try to embarrass Danny like that? The man has ANGER ISSUES! You don't HUMP a man in front of an audience and expect to NOT get your ass beat, right? It looked like Johnny attacked him."
While the extent of Curry's pre-incident discussions with Bonaduce (who previously stated that "a lady in a headset," not Curry, suggested he go on stage and tell Dalton why he was being booed) remains unclear, video of the on-stage incident -- which appears to support Bonaduce's version of events more than Dalton's -- has since been been released by Fox Reality. When reality stars attack, it can be dangerous.
Just ask former Survivor: Pearl Islands castaway Jon "Jonny Fairplay" Dalton, who allegedly had a physical confrontation with Breaking Bonaduce star Danny Bonaduce during last night's filming of the Fox Reality Channel Really Awards 2007, an altercation that ended with Dalton bloody and being taken away in an ambulance.
During this morning's broadcast of the syndicated The Adam Carolla radio show -- which Bonaduce regularly appears on as a co-host -- the former child actor claims he was preparing to leave the second-annual awards ceremony after serving as a presenter.
"Jonny Fairplay is on the stage and I can't tell if he's supposed to be there or not," said Bonaduce, adding Dalton was being booed by the studio audience for lying about his grandmother's death to win a Pearl Islands Reward Challenge during Survivor's Fall 2003 seventh edition.
"He just starts going, 'Why you booing me!? Why are you booing me?' [to the audience]," Bonaduce told Carolla. "So as I walk by, I say to [my girlfriend], 'They're booing him because they hate him.'"
Then, after "a lady in a headset" suggested he do so, Bonaduce said he decided to go on-stage and tell Dalton that to his face.
"I go, 'Okay,'" continued Bonaduce. "I walk-up on stage and I go... 'Buddy, They're booing because people hate you.'"
Bonaduce then claims he started to leave the stage -- with Dalton "10 feet" away -- when he heard the former Survivor castaway yell, "Hey!."
"I turn around, and just as I turn around he comes running at me, leaps in the air, wraps his legs around my waist and both arms around my neck," Bonaduce told Carolla. "I'm being fully throttled arms and legs. He's got me in what I will refer to as the 'death grip'... he's jerking back and forth in what could be construed as mock sex or trying to knock me to the ground. He's shaking me."
Bonaduce said he was unaware Dalton "would be so light," and things apparently got out of control from there.
"I just grabbed the butt of his jeans and push[ed him] straight-up in the air," Bonaduce told Carolla. "Well, he goes flying over my head and apparently landed behind me on his seat."
Bonaduce added he's "sure" Dalton will try to sue him for the incident, which TMZ.com reported ended with Dalton leaving in an ambulance with a few less teeth as well as a broken toe.
A "friend" of Dalton told TMZ the former Survivor castaway spent from 2-4:30AM with dentist Dr. Dean Carlston, who worked on his mouth. Dalton's friend also told TMZ that he "absolutely did not attack" Bonaduce and has since filed a felony battery report with police that names Bonaduce as a suspect.
"[Dalton] has every intention of seeing this through," the friend told TMZ.
Bonaduce is apparently sticking with his side of the story, telling TMZ on Wednesday morning that Dalton was "just attacking the wrong guy."
"There's all sorts of film on it, you decide if it's [self defense]," Bonaduce told TMZ. "He just shouldn't of put his arms and legs around me and tried to throttle me."
Bonaduce added he's aware he's a suspect but said no warrant has been issued for his arrest.
"I don't really know the law on this," he told TMZ. "I'm assuming they'll view the tape, they'll see this guy jump on me, see him go over the top, that will be that. I'm sure in the very least it will be self defense."

Batten the hatches, former Survivor: Pearl Islands castaway Jonny Fairplay is reproducing.
Reality television star Jon Dalton and former America's Next Top Model fourth-season finalist Michelle Deighton are expecting their first child together, TMZ reported Monday.
"Michelle and I couldn't be more happier [sic] and I wouldn't LIE about that!" Dalton told TMZ.
Dalton competed under the "Jonny Fairplay" moniker during Survivor's pirate-themed seventh installment in Fall 2003, in which he finished third and failed to live up to his self-appointed nickname when he faked that he had just learned of his grandmother's death to win a Reward Challenge.
The Survivor: Pearl Islands appearance landed Dalton several additional reality television roles -- beginning in 2005 with E!'s Kill Reality, which documented the making of the horror film The Scorned and featured a cast entirely comprised of reality stars.
In 2006, Dalton participated in a special three-episode Reality Stars Fear Factor edition of NBC's since-cancelled Fear Factor reality series. This summer, he was part of the celebrity cast of CMT's Dancing with the Stars-like Ty Murray's Celebrity Bull Riding Challenge.
Deighton was one of the 14 catwalk wannabes featured on Top Model's fourth season and was the ninth girl eliminated.
Deighton confirmed Dalton's annuncement in a Monday evening posting on her MySpace blog.
"I'm sure some of you have already heard about mine and Jon's good news well if you haven't here it is... Baby Fairplay is on the way," Deighton wrote. "YES I'm serious and NO I'm not stupid, I was on the birth control shot. It just decided not to work!"
According to Deighton, she only discovered she was nearly four months pregnant about two weeks ago.
"My boobs started getting bigger, I started feeling nauseous and I gained a little bit of weight," Deighton wrote. "I started working out to lose the few pounds I had gained and every time I worked out I got really short of breath."
"I ended up going to the doctor for a check-up and told him about what I had been going through... he felt my stomach...he then said he thought I was about two months pregnant... [then] I went to a women's doctor and he said I'm not two months... try 17 weeks... that was about two weeks ago."
According to Deighton, Dalton was equally surprised to discover she was pregnant. "I had to tell Jon and to tell you the truth I was really, really excited from the start, unbelievable scared also but really happy," Deighton wrote. "He was really, really shocked."
The couple is hoping for a baby boy, according to Deighton.
"I grew up around girls so I think it's about time I'm around a baby boy. Jon just wants a boy because he just really wants a boy," wrote Deighton. "I don't think he has ever held a baby but I could be wrong. All I know is that he is going to make a great father and I'm happy that this happened."
Deighton and Dalton have been dating for two years, according to TMZ. Deighton believes she's due around January 30.

The final ratings results are in for the Sunday, December 14 finale of Survivor: Pearl Islands, and, as expected, the program dominated the evening, drawing over 25 million viewers and hitting ratings highs not seen since the May 2002 finale of the Survivor: Marquesas.
Despite being delayed by NFL football coverage in many markets, the finale of Survivor: Pearl Islands dominated its time period in households (13.0/19), viewers (25.23 million), adults 25-54 (11.4/23), women 25-54 (12.3/25), men 25-54 (10.5/21), adults 18-49 (9.7/22) and adults 18-34 (7.4/19). The Survivor: Pearl Islands finale was the night's highest rated program in households and key demos as well as the night's most watched program, with the program's ratings steadily increasing throughout the broadcast and peaking with an average of 26.19 million viewers during the 9:30-10:00 PM ET time period.
The episode was the most watched and best delivery in adults 25-54 for a Survivor finale since Survivor: Marquesas (on May, 19 2002) and best Adults 18-34 and Adults 18-49 demographic finale delivery since Survivor: Thailand (on December 19, 2002). The Survivor finale was so dominant that it easily topped the combined delivery of NBC, ABC and FOX in viewers (25.23m vs. 25.07m), adults 25-54 (11.4/23 vs. 10.6/19) and adults 18-49 (9.7/22 vs. 8.8/20) during the 8-10PM ET time period.
Following after the two-hour finale at 10 PM ET, Survivor Pearl Islands: The Reunion draw 21.87 million viewers and also won its time period in households (11.5/18), adults 25-54 (10.5/22), women 25-54 (11.6/24), men 25-54 (9.3/20), adults 18-49 (9.2/21) and adults 18-34 (7.1/19). Survivor Pearl Islands: The Reunion easily topped NBC and ABC combined by +58% in adults 18-34 (7.1/19 vs. 4.5/12), +59% in adults 18-49 (9.2/21 vs. 5.8/14) and +46% in adults 25-54 (10.5/22 vs. 7.2/15) and by +2.32m viewers (21.87m vs. 19.55m)
Survivor Pearl Islands: The Reunion retained a remarkable 96% of its finale lead-in in adults 18-34 (7.1/19 from 7.4/19) and 95% of its adults 18-49 (9.2/21 from 9.7/22). The program was the most watched Reunion show since the Survivor: The Australian Outback aired way back on May 3, 2001.

Surprisingly, the original Internet gambling spoiler was right for the second straight edition of Survivor.
In last night's finale of Survivor: Pearl Islands, Sandra Diaz-Twine, a 29-year-old former U.S. Army specialist and mother of two from Ft. Lewis, Washington, became the first Hispanic winner of the $1 million Survivor first prize. In an all-woman finale -- guaranteeing a female winner for the first time in an odd-numbered Survivor season, Sandra (of Puerto Rican ancestry) crushed Lillian Morris, a 51-year-old mother and scoutmaster from Cincinnati, Ohio, by a 6-1 margin. Only Tijuana Bradley, Lillian's former tribemate in Morgan, voted for Lil; everyone else -- Ryan Opray, Rupert Boneham, Christa Hastie, Burton Roberts, Darrah Johnson and Jon Dalton -- voted for Sandra ... despite the fact that Sandra never won a challenge during the entire show.
To the jury, Sandra's honesty and in-your-face manner was preferable to Lil's continual neediness and backstabbing. Lil found herself more than once regretting her choice of clothing, as many of the jurors noted that Lil had failed to play the game according to the Boy Scout oath of honesty, while Sandra had generally been upfront about her choices and decisions. Lil's final words were another lament about her choice of clothes, saying that she wouldn't have worn them if she'd had a choice. We note that Lil's regrets came about because she broke the fundamental rule of Scouting: BE PREPARED.

With its two-hour finale set for broadcast on Sunday, December 14, the December 11 penultimate episode of Survivor: Pearl Islands attracted the program's best ratings yet, drawing its largest audience and placing first in viewers, households, Adults 18-49 and Adults 25-54.
The December 11 episode of Survivor: Pearl Islands drew viewers 22.40 million viewers, 200,000 more viewers than the edition's previous largest audience, accomplished one week earlier. Additionally, Survivor: Pearl Islands dominated its time period in households (12.8/20), adults 25-54 (9.8/25) and adults 18-49 (8.2/23). Survivor won both half-hours in households, viewers, Adults 25-54 and Adults 18-49.
This is Survivor's most watched Pearl Islands episode and the night's second highest rated and second most watched program, behind CSI: Crime Scene Investigation, which drew 26.81 million viewers.

This week's classic Survivor lesson? Pride cometh before the fall. Again.
In a display of overwhelming hubris and hypocritism that possibly set new highs for a series that's now been airing for seven ediions, "Outcast" returnee Burton Roberts became the first two-time loser in Tribal Council history. ...and then promptly moaned about fellow castaway Lillian Morris' "betrayal" of their alliance -- only moments after Burton and his ally Jon Ross had voted for Lillian's ouster before coming out on the short end of the 3-2 vote.
In a bit of Survivor editing that we're guessing even series producer Mark Burnett would secretly admit to enjoying, the extreme overconfidence and arrogance of the duo was repeated stressed throughout the episode, who's seemingly endlessly negative comments about women are likely to haunt them for some time. However, when the Tribal Council vote came, it was the three woman alliance of Lillian, Darrah, and Sandra who felt they got the last laugh (along with, judging from their reactions, apparently the majority of the existing jury).
This week's correct prediction of Burton's second booting left SurvivorBlows' prediction record at 11-0-3 (eleven correct predictions, zero incorrect, and three correct alternate bootee.) In Spoiler Island fantasy game action, there's yet another new lead change atop the leaderboard -- "Brownroach" and "richthedevil" are now in a two-tie for first place as we wind down to this Sunday's finale.
So what happens in the Survivor finale? Will the truth ever come out regarding Jon's grandmother? Will the women stick together and oust Jon or will Jon manage to worm his way into the Final 3? Will Darrah ever lose immunity? And will the longstanding Final 2 and winner rumors finally turn out to be true?
