Contractor Alfred LaPonza, who appeared as "Fredo" in a previous season of "Average Joe," filed the suit along with two other Cleveland area men seeking $40 million from NBC, WKYC-TV, Cleveland, reported Wednesday.

The three claim they suggested the makeovers and other concepts being utilized this season as a group of "Average Joes" compete with hunks for the affections of a beautiful woman.

NBC told its Cleveland affiliate it had no comment on the suit.
